HOA Fee Increase and Changes in Oregon

Hello,

I currently live in Woodburn Estates and Golf HOA here in Woodburn Oregon. We are a 55+ single family home community and the holdings of the association include a golf course, golf club, pool and several other nice opportunities for recreation.

The golf club and course were not a mandatory membership at time of homeowners purchasing here in the Estates.

However no due to COVID and lack of participation, the golf club and course are struggling financially and while looking at the budget the board is optioning to make the golf membership mandatory and adding it to the HOA fee. Can they do that with out a membership vote?

Also, is there an annual limit to how much an HOA fee can be increased in Oregon?

Hi John,

It depends on what your declaration states. If making the golf membership mandatory would require amending your declaration, then this amendment will need approval from the membership as Oregon law stipulates (at least 75 percent of the total votes or any larger percentage your declaration specifies). Additionally, Oregon law does not currently limit how much an HOA fee can be raised.
