Homeowner Unaware of the HOA

Question:

I’ve lived here at my address 5712 East Sycamore Street, Evansville In 47715

They have a Neighborhood association and we never got a copy and a neighbor who asked us to join and we said no. We would not have bought our home had we known. Anyway five years later they are telling us what we can do now because we bought a little lot next door. Is there anything we can do?

Hi Ron,

If the HOA already existed at the time of your purchase, your seller or seller’s agent should have provided you with a copy of the HOA documents as part of a disclosure packet. Some forget to do this, though. Contact your seller or agent to see what can be done. Technically, you are already part of the HOA because you agreed to join it upon the purchase of the property. As such, you will have to abide by its rules.

However, if an HOA formed after you purchased the property and you declined to join, then you should not be a part of the HOA. Let the HOA know that you never signed or agreed to join the HOA in its initial creation.
