Maryland HOA Not in Good Standing

Question:

We purchased our home in August 2021- we were never told of a former HOA that existed when we purchased our home. We have a common area easement that is shared ingress and egress for 3 lots to access their private driveway- we’ve had issues with neighbors parking on the easement and found out that the is a HOA not in good standing.

How do we go about reinstating the HOA? We’d like for the Declaration of Covenants and Declaration of Easement to be followed and enforced.

Hi Julie,

If the HOA is registered in the state of Maryland, it is important to find out why the HOA is not in good standing. Some of the most common reasons include a missing Annual Report and Business Personal Property Return (Form 1), a monetary penalty as a result of the late filing of Form 1, dishonored payments, or an issue with the Office of the Comptroller or Department of Labor. Once you determine the reason, remedy it as soon as possible.

It is worth noting that easements can also exist outside of an HOA. Make sure to find out whether the easement is linked to an HOA or not.
