Parking on Public Streets in Texas HOA

Question:

My HOA is restricting us from parking on the street overnight. We are not a private community. Streets are repaired by the city/government. Can the HOA do anything about parking on the street overnight? It does state it in the CCR.

Hi Dawn,

If the HOA owns the street, then it is possible for it to regulate parking on the street. However, if the street is owned by the government, the HOA does not have authority over it. That being said, you should check with your local government to see if it has given your HOA the authority to regulate street parking. Additionally, you should check to see if your local government also has a rule in place stating that you can’t park on the street overnight.
