Question:
HOA Laws – California and updating governing documents:
Hi and thank you for your time.
I am a member of a small self-managed 6 unit HOA with governing documents that have not been updated since 1986. What actually needs to be done for the documents to be compliant with current CA laws? Do all of the laws listed on your site under CA need to be incorporated?
Or is it just the election law that needs to be adopted? And if so, can we save money by updating the ByLaws only?
I am looking for a cost effective way to get this done, but also want to have a complete understanding of the process. Any guidance you could provide would be most helpful.

Answer:
Hi Fran,
If any provisions in your governing documents conflict with state and local laws, they become unenforceable. As such, it is important to update your CC&Rs, bylaws, and operating rules to comply with the laws in your area. It is best to seek the help of a lawyer when amending your governing documents.
