Amending Voting Process in Georgia HOA

Our voting is based on percentage of units (sq ft) owned. We have had an individual come in and purchase multiple units and now has full control. Can the voting process be changed in our rules so every homeowner has a fair chance of their vote to count.

Hi Piper,

You may change your voting process by amending your governing documents. To do this, it is important to follow the requirements and procedures laid out under Section 44-3-93 of the Georgia Condominium Act (for condominiums) or Section 44-3-226 of the Georgia Property Owners’ Association Act (for HOAs). Your CC&Rs and bylaws themsleves may also contain provisions guiding the amendment.
