Question:
Under the rights for homeowners, my question is does every HOA, in every state, have to offer disciplinary hearings? Our HOA promised to meet with us, never did, and the HOA said they received my requested legal opinion but never shared it with me. I would think for the HOA to continually mislead a homeowner is a violation of their Fiduciary duties. Thanks for your advice

Not all states require HOAs to hold disciplinary hearings. Similarly, not all HOAs are required by their governing documents to hold disciplinary hearings. Louisiana is one state that does not require HOAs to hold disciplinary hearings. To know if your HOA is required by its governing documents, make sure to review your bylaws and CC&Rs.
