Question:
Why are service vehicles allowed to park in handicap parking, I’m disabled and I am blocked from parking when people who don’t belong there, can this be resolved? Also whoever it is either moving in or out they’re very loud 12am

Answer:
Hi Stacey,
In Utah, it is illegal for anyone to park in a handicap parking space without a valid disability placard or plate. This includes moving trucks, contractors, or delivery vans. These spaces are protected under both federal law (ADA) and Utah Code § 41-1a-414, which prohibits unauthorized parking in designated accessible spaces.
Your HOA is responsible for enforcing parking rules on private property, especially when it involves protected spaces like handicap spots. If a service vehicle consistently parks in these areas without proper permits, the HOA must take corrective action. Let your HOA board know about the issue. Submit a formal complaint to the HOA, including the time, date, and photos or vehicle details.
As for noise at 12 a.m., your HOA governing documents and local city ordinances likely include quiet hours. Even during move-ins or move-outs, residents and contractors are expected to comply with these rules. If the noise is excessive or consistent, you should document the disturbances and report them to the HOA or the local police.
