Conflict from HOA President

Question:

Hi there I am the VP of our Masters Board here. We have the President of the Single Family Board that is causing conflicts in our neighborhood. He has a buisness in here that’s not licensed or insured and he has a guy that works for him who’s on his fining committee. He offers lawn, pressure washing and painting services in this neighborhood. He also flies drones over people’s back yards to spy on them and to issue more fines. He has also threatened to fight residents in the streets. We have him on camera smoking week with a drug dealer at his home and in our clubhouse. We do not know what to do and this guy keeps harrassing us and the residents. Please advise.

Answer:

Hi Joseph,

You may recall or remove the problem board member. The Florida Homeowners’ Association Act Section 720.303(10)(a)(1) states that the HOA may recall board members with or without cause by a majority of total voting interests.

The HOA may also issue violation notices to the board member if they are violating the rules regarding smoking or flying drones. The residents may also report the harassment to the HOA board. As for the unlicensed business, it may be best to consult a lawyer.
