Director Singling Out Violations Committed by Families on Social Media

Question:

A board member at our condo has shown tendency on social media to single out families for potential violation issues. He does not take to social media for other complaints he has expressed in the board meetings, such as washing cars in the garage area. Does this cross over into fair housing and discrimination/bias towards families? What can be done if the behavior persists?

Answer:

Hi Chelsea,

It may depend on whether or not the board member specifically singles out families and not other community members and households. If so, then it may be considered discrimination as familial status is a protected class under theĀ Fair Housing Act.

Regardless, you may speak with the board and ask them to resolve violations privately. You may also review the governing documents to see if there are ethics or behavioral policies for board members and raise the issue with the board. If the person continues, you may remove the problem board member or ask an attorney for further guidance.
