Question:
When an attorney is retained for the HOA, paid for by the HOA, do they represent the entire HOA or do they represent the Board of Directors when it comes to litigation? For example, if a group of owners sues the board and the HOA attorney represents the board in court, is this a conflict of interest?

Answer:
Hi Kimberly,
An HOA attorney represents the HOA as an entity, not the individual board members.
