Does an HOA Need Bylaws If It Has a Management Company?

Question:

If the HOA Board turns the management over to a management company, does the HOA still need by-laws?

– Randell

Answer:

Hi Randell,

Yes, an HOA still needs bylaws even if it employs a management company. An HOA management company is a professional firm that assists in the operation and management of a homeowners association. It must still follow the HOA’s governing documents, including the bylaws. An HOA can switch management companies, however, its bylaws remain intact, unless it decides to make amendments.
