Filing Legal Action Against Management Company

Question:

Changing management company because financials are and have been incorrect for years. Is it best to bring legal action while we’re there? Or should the HOA select another management company and file legal actions after transitioning?

Answer:

Hi Pamela,

It may be wise to consult an attorney to determine the best plan. Bringing legal action while the contract is ongoing could bring immediate accountability and allow easier access to the management company’s records. However, waiting to transition may also be beneficial to help you reorganize the records to present a clearer picture of the issue. The board may meet with the HOA attorney to discuss the best course of action.
