Question:
The HOA has in the bylaws full maintenance;,lawn cutting, chemical treatments, house paining after 6 yrs, but I do all myself and want the board to vote to amend this for those who want to opt out of this program, but they are refusing to entertain this. There are only about 66 villas have this and a 2/3 vote from all in the community have to vote to change these covenants, but I can’t get the board to help some of us who want to get out of this program to write an amendment in order to have the community vote.
The lawns look terrible, weeds, chemical burns, un-trimmed bushes, broken sprinklers etc… and when this is brought up we are being ignored or placated.
We pay almost 3 times as much larger houses that are not villas and are compelled to have their own upkeep.

You may raise this concern at a board meeting to get more input from the other residents. According to the Florida Homeowners’ Association Act Section 720.306(1)(b), amendments require a two-thirds vote of the voting interests unless otherwise specified by the governing documents. You may need to garner a lot of support from fellow residents.
If there is no upcoming board meeting, it may be helpful to hold a special meeting to discuss this issue. Section 720.306(3) states that special meetings may be called by at least 10% of the total voting interests (unless a different percentage is stated in the governing documents). You may speak with your fellow neighbors and garner support to hold a special meeting. For further guidance, kindly consult a lawyer.
