High Special Assessment in Florida HOA

Question:

Our HOA demands $2500.00 Assessment per unit in 76 unit community. There is no emergency. Residents are elderly, disabled physically and cognitively, etc. on fixed incomes already paying $495 a month HOA fee. We were told to get the money or end up in collections. This is an unreasonable request. Please help or send me to where we can get help. Thank you.

Answer:

Hi Donna,

Kindly review the governing documents to verify whether there are rules regarding special assessments. They may outline how much the board can charge and what the process entails. Apart from this, you may ask the board why the special assessment is being levied. There may be a serious repair, maintenance, or replacement issue with the common elements. You may also request a payment plan from the board to make the special assessment more manageable. For further guidance, kindly consult a lawyer.
