HOA Board Asking for Vehicle Registration

Question:

I am being asked to give a copy of my registration to the board for a vehicle I have in my garage It is not in my CCR and I am the only one in the community they are asking Our rules state there has to be able to park 2 vehicles in the garage. I have a motorcycle and a car in the garage every day This bothers the board It your garage is clean enough you don’t have to have 2 vehicles it just has to be able to park 2 cars

Hi Jann,

In California, HOA rules and enforcement actions must be applied uniformly and in accordance with the governing documents. If your CC&Rs do not require residents to provide vehicle registration, the board may not have the authority to demand it, especially if they are only asking you and not enforcing the same rule across the community.

If the board continues to single you out, you may request a written explanation of the rule they are citing and why they believe you are non-compliant. If they cannot provide a valid reason under the governing documents, you may have grounds to challenge their request as selective enforcement.
