HOA Harassment and Threats in South Carolina

Our HOA. Property owners association is insisting that we mitigate land on our property that is under Ocrm DHEC jurisdiction in a threatening manner with intent to cause financial harm. If we mitigate we violate an order by DHEC which we are clearly not going to do. Can an HOA/Property owners association wield that power? They are also fining us a very large sum of money without merit and without showing how they calculated the monetary value of their claim . They have held us up from building on our buildable lot for over a year now and we need your help and guidance. We are property owners in good standing being harassed financially by our POA

Hi Jill,

Federal and state laws trump the rules and regulations of a homeowners association. As such, the DHEC’s order takes precedence. As for threats and harassment, it may be worth talking to an attorney for advice on how to proceed.
