Question:
I am the President of a 22 unit HOA. There are three board members. The board members voted unanimously to have dangerous trees trimmed. I was lectured that we have to have the approval of the management company we hired. Is the management company correct?

Answer:
Hi John,
An HOA board has the authority to make maintenance and safety decisions for the community, including tree trimming, unless restricted by its governing documents. If the board voted unanimously to proceed, the management company generally does not have the power to override that decision. A management company is hired to execute board decisions, not to dictate them. That said, it is best to review your governing documents as well as your management contract.
