HOA President Personally Asks to Pause Recall Petition

Question:

Can a board president come up to me personally and ask me to put my recall petition on hold? Can the board and management company refuse to acknowledge a board member’s harassment of community members and subcontractor’s repeatedly?

Answer:

Hi Suzanne,

A board president can personally ask you to put your recall petition on hold, but you are under no obligation to comply. Regarding harassment by a board member, the HOA board and management company have a fiduciary duty to act when one of their directors engages in behavior that disrupts the community or violates law or policy. Repeated harassment of residents or subcontractors should be addressed through internal discipline, referral to legal counsel, or in serious cases, law enforcement.
