HOA Rules on Dog Leashes

Question:

I just moved into an HOA. They have a rule that no animal can be left unattended outside, even if on a lead. The law in Minnesota states that as long as my dog is properly restrained, it is acceptable to have him outside without me as long as he is not a nuisance.

From all I read, I do not believe their rule is enforceable as it breaks local law. Can you provide me any direction on this?

Kindly review the law in question. If the law simply allows dogs (which are not a nuisance) to be kept outside on a leash, the HOA may have the power to enact a more restrictive policy on the homeowners. Typically, homeowners associations are allowed to enact more restrictive rules.

However, if the law explicitly states that HOAs cannot prohibit owners from leaving their dogs outside on a leash, then the HOA may not be able to enforce the rule. You may also consult a lawyer for further guidance.
