Question:
our HOA has put in a new system and wants to only issue access fobs by home owners names to track their “individual” movements coming and going and using the common HOA facilities GYMS, Pools. I do not agree with any of my specific home guests being tracked. I have no issue with a fob allocated to my lot being tracked and monitored….Question are they legally able to enforce the tracking of individuals rather then the more reasonable use by an owner

Answer:
Hi Chris,
Homeowners associations often implement access control systems, such as fobs, to monitor and secure common areas like gyms and pools. While these measures aim to enhance security and ensure that only authorized individuals use the facilities, they can raise privacy concerns among residents.
Arizona law does not provide explicit guidelines on the extent to which HOAs can monitor individual movements within common areas. Therefore, the authority to implement such tracking typically stems from the association’s governing documents. Check your governing documents to see if they outline the HOA’s rights and limitations regarding the use of surveillance and monitoring systems.
