HOA Zoom Board Meeting Notice in Colorado

Question:

Can an HOA Board meet via zoom without notice to community members?

Answer:

Hi Judy,

In Colorado, the Colorado Common Interest Ownership Act (CCIOA) mandates that all HOA board meetings, including those conducted via platforms like Zoom, must be open to homeowners. However, CCIOA does not explicitly require that notice of these board meetings be provided to members.

Section 38-33.3-308(1) of the Colorado Common Interest Ownership Act (CCIOA) specifies notice requirements for meetings of unit owners, not for HOA board meetings. This section mandates that notice of unit owner meetings be provided no less than ten and no more than fifty days in advance, including details such as time, place, and agenda items. However, CCIOA does not impose similar statutory notice requirements for HOA board meetings.

It’s essential to review your HOA’s bylaws to determine if they stipulate any notice requirements for board meetings. Even in the absence of such a requirement, it’s considered best practice for HOA boards to inform members about upcoming meetings.
