Question:
I own a townhouse in an HOA community. The by-laws are 35 years old (1988) and have never been updated. By law in Pennsylvania, how often should they be updated? A friend of mine lives in a condo and her HOA updates their by-laws every 3 to 5 years. I asked the President of the HOA about it and he checked with the Management company who told him that their lawyers felt it wasn’t necessary to do it. What do you think?

Answer:
Hi Elizabeth,
There is no requirement to update the bylaws every X number of years. That said, it is common practice to review the bylaws every now and then to see if there is anything that needs updating (for instance, if a provision in the bylaws is outdated in light of new laws, ordinances, etc.).
