Levying HOA Special Assessments in Alabama

Can our Property Management company levey a special assessment to each association member to pay for a bulk cable tv agreement to Spectrum TV because it wasn’t in the budget because the board wanted to cancel the contract, but didn’t make the request to cancel in the required amount of time?

Homeowners associations in Alabama generally can levy special assessments. However, it is best to check your HOA’s governing documents for specific guidelines on charging those special assessments. If you disagree with the board’s decision and believe they are at fault, you should bring up your concern to the HOA board. You may do this by contacting your HOA board or raising the concern at the next board meeting.

The HOA board should check to see if it can still cancel the HOA’s agreement with the cable company, even if the required time has lapsed. The HOA may need to pay a termination fee. Compare this termination fee with the cost of renewing the agreement and see which one works out better for the HOA financially.
