New Owner Assessment in Arizona HOA

I took care of my mom who had dementia. In 2022, I had to refinance her house as she was running out of money but I had to add myself as she did not qualify to refi on her own. This added me to the deed and no one said anything. My mom passed in September 2023 and I am now trying to sell the house but the HOA says I must pay a ‘new owner’ assessment that my mom incurred in 2022 when I was added to the deed. I am disabled and this is all I have. For me, paying $4,300 is a lot. It does not seem right. Can they do this?

Check your HOA’s governing documents to see if the HOA has the authority to charge a new owner assessment and what the procedures/requirements are in relation to this assessment. You should also check whether or not the HOA can charge this assessment retroactively.
