This would depend on how your CC&Rs and bylaws are worded. Perhaps the president or treasurer is the designated point of contact with the attorney.
Generally, though, it is best for board members to include other board members on any communication with the HOA attorney. It may be better to start a conversation with your president or treasurer and ask them why they felt the need to contact the attorney privately. You should also ask what the message was about.
