Retroactive HOA Rules

Question:

We have security cameras that have been attached to our house for 10 years. The new board of directors has added to our rules and regulations that security cameras attached to the house are no longer allowed, but people can have ring doorbells. Are we grandfathered in and are they allowed to make these new rules retroactive?

Answer:

Hi Patsy,

Generally, retroactive rules are permissible and enforceable. However, the HOA may consider grandfathering in some units or homeowners depending on the situation. Kindly speak with your HOA board to ask about your options. For further guidance, kindly consult a lawyer.
