Question:
Can the rules for bringing RV into residential culdesac be changed for safety reasons (danger of the elderly guests being run over by RV, danger of children playing being hit by the RV)? I have been going back and forth for the past 10 years with the Association about the nuisance of driving a huge RV inside the culdesac and parking it for 48 hours! The association have not been able to do anything about this and they do not seem to have any capacity to enlighten this RV owner the dangers involved. Here is my last email to the association with no response:
The guest parking spot has been occupied by RV and is being washed and cleaned ! It’s an ugly sight for the guests to walk on dirty water flowing into the road and on top of it even if a second parking spot is open, it is very inconvenient when the water pipes are running across and the door of RV wide open onto the second parking spot and for lack of space !
The RV is back and the place has been occupied this time for repairs !! culdesac is turning into RV washing and repair and parking Center !!!! Look into it !’ The culdesac has turned into a commercial center RV garage !
Can you advise?
Answer:
Hi,
Kindly review the governing documents to verify the community’s rules about parking RVs and guest parking. If there are no rules against it, the RV may be allowed to park as long as it follows community guidelines. However, homeowners who want to make a change may propose a rule change or amendment to the HOA board at a board meeting. Outline the reasons why it may pose a safety risk for other members. It may be helpful to gather support from other residents as well.
You may submit a formal request to the board to ensure proper documentation. You may also call a special meeting to discuss the issue. According to the Illinois Common Interest Community Association Act Section 1-40(b)(3), the community may hold a special meeting if 20% of the membership calls for it. If the board is uncooperative, you may consider third-party mediation or arbitration to resolve the dispute. For further guidance, kindly consult a lawyer.
