Second Feedback Period for ACC Changes

Question:

Hello, We are looking to change some rules in our ACC guidelines. We have sent out the proposed rules for the feedback period from the members. We plan to vote at our next Board meeting to adopt the rules. I’m trying to understand how the feedback period works. Are we able to make changes to the rules based on the feedback from the community and then adopt the rules? Or would we need to send out the revised rules for another 28 day feedback period? We have 7 new rules, but we are getting some opposition on one of the rules. Please let me know.

Answer:

Hi Margaret,

It may depend on the specific wording in the governing documents. If the governing documents require the board to adjust to the homeowners’ feedback and provide another feedback period, the board must follow suit. If the provisions are unclear, the board may be able to act based on their interpretation of the governing documents. Some may also provide a second feedback period if there are substantial changes to the initial proposal. For further guidance, kindly consult a lawyer.
