Question:

why is it that i had to have approval for many things that i wanted to do to the exterior of my home for example painting and new roof color fencing etc i also wanted to keep a camper in my driveway the management company told me no but other homeowners have trailers boats etc in their driveways our bylaws clearly state no trailers etc and other homeowners painted their homes whatever color they wanted is that not discrimination

Answer:

Hi William,

It is common for HOAs to have architectural standards and rules on parking/vehicles that homeowners must adhere to. Many communities require homeowners to request approval before making changes to their home’s exterior to ensure consistency and compliance with aesthetic guidelines.

If your HOA’s CC&Rs explicitly prohibit certain items, like trailers or specific paint colors, and you see violations that aren’t being addressed, you may have grounds to request enforcement of the rules. It’s important to check whether these restrictions are clearly outlined in the documents that govern your community

If you believe that you are being treated unfairly, it might help to raise the issue with the board or the management company in writing. Ask for clarification on why your request was denied when other homeowners appear to be in violation. In some cases, the board might be unaware of the selective enforcement and might correct the issue.
