Question:
Our neighborhood is a private community and we do our own roads/easement services. Because we’re rural we have horrible internet. We have a proposal from Spectrum to install fiber optic cable and provide a bulk services agreement. Spectrum will only contract with the association, who then has to bill each owner engaged in the service. We’d like to start a new not-for-profit / HOA specifically for telecommunications bulk service for owners. (Lots of reason we need to do that). Would a Homeowners Telecommunications Association fall under the rules of an HOA? Thanks.

Answer:
Hi Leisa,
It may depend on how the non-profit is organized and structured. HOAs are typically formed by creating governing documents that govern the community. If the organization acts mostly like a homeowners association then it may be subject to HOA laws and rules. It may be best to consult a lawyer familiar with HOA law to help you gain a better understanding.
