Trying to Settle Unpaid HOA Dues

I did not pay my HOA dues the previous year and last year when I tried to pay they did not let me. An attorney is trying to settle but the fees as more than triple. I wrote a hardship letter and got denied. What can I do?

In Texas, HOAs have the legal authority to collect unpaid dues and impose additional fees, including late fees, interest, and attorney costs, if payments are not made on time. However, you still have options to address the situation, reduce the financial burden, and avoid further complications.

Review your governing documents, specifically the CC&Rs to see if you have any options. If your hardship letter was denied, consider proposing a payment plan directly with the HOA or their attorney. Your CC&Rs should be able to tell you whether or not you have a right to a payment plan.
