According to the Ohio Planned Community Law Section 5312.08, the HOA is responsible for maintaining the common areas and the homeowners are responsible for their separate interests (i.e. individual units) unless otherwise specified in the governing documents.
However, it’s important to review the governing documents as they may outline who is responsible for pest control. It may or may not indicate that the one responsible for causing the infestation is responsible. If there are no provisions in the governing documents, the HOA may want to add an amendment to clarify these issues and avoid future problems and misunderstandings with homeowners.
