Wood Fence Requirements in Texas HOA

Question:

I am buying a new home in Alvarado Texas. There is a metal fence on 2 sides of the property that belong to a ranch not part of the HOA. I am wanting to install a Wood privacy fence on the sides of the house and along the other side of the property. Joining them to the existing metal fence. HOA is saying I have to put the same wood fence along the existing metal fences as well…. Is this legal and enforcable for them to say this??

Answer:

Hi Lawrence,

It is normal for an HOA to enforce restrictions when it comes to architectural changes, including fences. Many associations regulate the height, size, and even materials used for fencing. Your HOA is likely requiring you to put the same wood fence to maintain consistency and aesthetics. Check your governing documents, particularly your CC&Rs, to understand the architectural guidelines in your HOA.
