The HOA is trying to make changes to the CC&Rs without holding a vote. They’re making decisions without input from the homeowners, and it feels like they’re overstepping their authority. Is this legal? Can we challenge it?

Changes to the CC&Rs typically require homeowner approval. The board can’t unilaterally make changes without a vote. If they’re bypassing the proper procedures, I would recommend talking to a lawyer who specializes in HOA law to figure out the best course of action.

It’s definitely possible to challenge these changes, especially if the HOA is ignoring the voting process. I suggest reaching out to other homeowners who may feel the same way and request a special meeting to discuss the issue. If you get enough support, it’ll be harder for them to ignore.

You may also want to check if your community’s governing documents allow for a petition or a vote from homeowners to block or challenge changes to the CC&Rs. If it’s a clear violation of the rules, you may have legal recourse to challenge their decision.

If the HOA is making these changes without following the right process, you could be entitled to push back. Try gathering evidence that shows they’re bypassing required procedures and bring it up at the next board meeting or file a formal dispute if necessary.
