A man in Union County receives an HOA violation for a pride flag hanging in his front yard. He believes the homeowners association is targeting him for his sexuality.

 

HOA Violation for a Pride Flag

Nick Crowley, a gay man living in Union County in Indian Trail, North Carolina, is fighting against his homeowners association. The man has been living in the neighborhood for over 20 years. In September 2023, he received an HOA violation for a pride flag he had hung in his front yard. According to Holly Park HOA, it is against the community rules to hang any flag apart from the American flag.

However, many other homeowners in the community also have different banners hanging in their front yards. Thus, this practice may be a case of selective enforcement. As a result, the homeowner believes the Holly Park Association is wrongfully attacking him for his sexuality. According to Crowley, they’re telling him he’s not worthy and not good enough to be with them or in the community.

He says the problem is not anything he did but who he is. Crowley also notes someone is stalking his house, watching him, and harassing him. He says he is proud of being a gay man.

 

Case Closed and Reopened

After receiving the initial notice, Crowley approached WBTV and stated that other neighborhood properties were flying non-American flags. After airing the story, he says the case was closed. However, the file was since reopened months later. Someone is taking photos of his home and posting them on the website. This happened even though he switched the banner in the yard to a Pride American flag.

According to Crowley, the document the founding neighborhood homeowners association published should precede the HOA bylaws. He stated that the founding document prohibits any discrimination inside the neighborhood.

Crowley says they’re telling him to take down the flag, and it might save a child’s life, but he is not going to do it. The neighborhood HOA has yet to respond after WBTV reached out to them.
