Agenda Included in Meeting Notice in Minnesota

Question:

Our documents state an agenda is to be sent to all homeowners along with the notice of meeting for the annual meeting. The documents and Minnesota state statutes are silent as to an agenda being included with the meeting notice for monthly board meetings. Is an agenda required to be sent to homeowners for the monthly board meetings for a CIC in Minnesota? Is it perhaps a good practice if not required?
How are residents to know what will be discussed or voted on without an agenda ?

Answer:

Hi Kathleen,

According to the Minnesota Common Interest Ownership Act Section 515B.3-108(c), notice of any meeting shall include the purposes of the meeting. It does not specifically require the agenda but instead requires the reason why the meeting is being held. However, if the governing documents indicate that the HOA must include the agenda in the notice, the association must follow. It is also a good practice as the homeowners can come prepared with their questions and concerns beforehand.
