Amending Documents to Include Rental Restrictions in Mississippi

Question:

Our board of directors would like to make an amendment to our current bylaws by adding verbiage regarding rentals. We have numerous rentals and they could be grandfathered in, but we don’t want any additional rentals and would like to restriction them in our neighborhood moving forward.

Answer:

Hi Kimberly,

It is possible for an HOA to restrict rentals in Mississippi, but this would require an amendment to the governing documents, specifically the declaration or CC&Rs. Some associations limit rentals to a certain percentage of homes, while others have a specific number permissible. It is best to seek the help of a lawyer to draft the amendment and make sure the policy does not conflict with existing laws or provisions in your governing documents.
