Applicability of HOA Laws in Maine

Are Maine “Lot Owners Associations” subject to the same laws as Homeowners Associations (eg Condominium Association)?

Answer:

Hi Daniel,

The Maine Unit Ownership Act §562 states: “This chapter shall be applicable only to property, the sole owner or all of the owners of which submit the same to the provisions of this chapter by duly executing and recording a declaration as provided.”

Similarly, the Maine Condominium Act §1601-102 states: “(a) This Act applies to all condominiums created, in accordance with the provisions of this Act, within this State after the effective date of this Act and to all condominiums created within this State before the effective date of this Act which, on or after the effective date of this Act, amend the instruments creating the same so as to subject the condominium to the provisions of this Act and so as to conform those instruments to the provisions of this Act in all necessary respects.”
