Architectural Review in North Carolina HOA

Question:

How should the HOA ACC deal with a homeowner / builder that has installed an excessive number of downlights in their roof overhang. House looks like a commercial building.

Hi Thomas,

It depends on what’s stated in the HOA’s architectural guidelines. If the lights are in violation, then the ACC may enforce the standards set by the association by following the HOA’s enforcement procedures. The board also has the power to adopt or amend the architectural guidelines, but they must not contradict the CC&Rs. The board may also need to notify all the HOA members before the change can be adopted.
