Are Board Meetings Required in SC?

Question:

Our HOA Board has everything running through our management company. I’ve requested them to hold some other quarterly meetings besides the annual meeting to get acquainted with the board. They said they can’t due to the cost, etc. We’ve tried to get a meeting with them but it’s like pulling teeth. Some of us just want to know who they are, not a business meeting. What can members of the HOA do to get them to have something? They live in our development (neighbors) but it’s like pulling teeth and we have to go through the Management company to request things? Please advise as to what we can do or do we have to just go through their process. Thanks for your time.

Answer:

Hi Fred,

Make sure to check your bylaws to see if they require your board to hold board meetings apart from just the annual meeting. If the bylaws require board meetings, then your board must hold them. Board meetings are also open to all homeowners, as per the South Carolina HOA Act Section 27-52-150(B) and (C). Homeowners may also be able to call for a special meeting. Check your governing documents for the requirements for calling on special meetings by homeowners.
