Are Guests Allowed in HOA Common Areas in Rhode Island?

Question:

When an HOA has common lot property – where each private lot owner has an undivided interest in the common lot – and the “Conditions and Restrictions” (Covenants) and “Bylaws” do not specify who may or may not use the common lot property, could one private lot owner allow friends or family (‘guests’) to use the common lot property without the private lot owner’s presence? Or is the use only limited to the ‘homeowners of record’? Thank you!

Hi Brad,

It depends on your governing documents. Your CC&Rs, bylaws, and operating rules should tell you whether or not a homeowner’s guests are permitted in common areas when the homeowner is not present.
