Are New Rules Effective If They Are Not Communicated?

Question:

The board can change the rules here when they want. My question is if a new set of rules with the changes is not given to all the residents is the old set of printed rules still in effect? We have been without the rules with changes for months, at least 6 months.

Answer:

Hi Pamela,

Your governing documents will typically outline how the board should communicate new rule changes to residents. If the board fails to follow this requirement, the rule change may be deemed void or unenforceable. However, it is still best to consult an attorney for further guidance on this matter.
