Are Patio Doors in Condos Limited Common Elements?

We have a renter who is a problem. There’s a leak from his patio doors to condo below. He refuses to fix until the association fixes gutters. We hired contractors to find the leak which they did. And now he will not comply. Are patio doors part of limited common elements?

Hi Ed,

If the condo was made 120 days after July 2, 1980, it is subject to the Pennsylvania Uniform Condominium Act Section 3202(4) which states that patios, exterior doors, and fixtures located outside the unit’s boundaries designed to serve a single unit are limited common elements allocated exclusively to that unit, unless otherwise specified in the governing documents.

Kindly review the governing documents to verify unit boundaries and how patio doors are treated. If none exists, you may refer to the section previously mentioned. For further guidance, kindly consult a lawyer.
