Association Requiring HO3 Insurance

Question:

I have no mortgage and own my villa/condo 100%. My HOA is forcing me to get HO3 insurance. I have never had insurance on my unit, the HOA has always insured their interest- exterior with our HOA dues. Is it legal for my HOA to force me to obtain HO3 insurance? My dues have not come down, but only have gone up so they are still taking money for insurance of their interest (exterior).
My original bylaws never required us to hold insurance, but they just put in a page stating it’s now required. What are my rights?

Hi Tracey,

Community associations are generally allowed to require the members to obtain homeowners insurance. If the governing documents were amended to include the requirement, and the amendment followed due process, then the unit owners may need to comply. For further guidance, kindly consult a lawyer.
