Automatic Membership in an HOA in Texas

Question:

If a property was not a part of the HOA in the beginning organization of the HOA, is the new property owner excluded or included in the HOA at the time that original ownership ceases and new owner begins?

Hi Larry,

It is not usually the individual homeowners who are tied to the HOA. Membership is usually attached to the property. As such, when a property that belongs in an HOA changes hands, the new homeowner becomes a member. To answer your question then, the new owner should not be a part of the HOA if they bought a property that does not belong in the HOA.
