Can HOA Ban Front-Facing Solar Panels in Nort Carolina?

Question:

Can an HOA prevent solar panels visible from the street to be installed on homeowner’s roofs?

Answer:

Hi David,

According to North Carolina’s solar access law, HOAs cannot prohibit homeowners from installing solar panels. The same law states that HOAs can only ban front-facing solar panels if it is explicitly outlined within the community’s rules. However, a recent Supreme Court ruling also affirmed homeowners’ right to solar panels on rooftops, concluding that the HOA could not limit the placement of solar panels to the back of the home if it would prevent the reasonable use of the panels.
