Our community is having an issue with some busy beavers in the common area ponds and homes on the water. They have done minimal damage so far and are not restricting any waterflow. Nonetheless people are up in arms about the possibilities.
Questions: Is the HOA legally responsible or liable for any damage done by a beaver to some one’s private property?
Is the HOA required to pay for the removal of nuisance wildlife such as beavers in common areas?

It is important to be careful when handling your community’s beaver problem. If your HOA takes action to control the problem and a homeowner’s property or safety is still compromised, a court may find your HOA liable. By acting on the problem, your HOA is saying that it is responsible for it and bearing all possible risks. Of course, that isn’t to say there isn’t anything you can do about it.
