Board Refuses to Remove Remedied Violation

Question:

I got a violation, first notice in December 2023 for cutting the grass. I did. I got another violation in February 2024 for the same thing, however, it was sent as a second violation with the date of the December violation of 2023. I acknowledged it and thinking it was a simple mistake, I immediately fixed the violation and brought it up to the HOA. The Board member responded with attitude and refused to clear the violation and stated that he would leave it there, in other words, keep stacking violations. 10 days have passed since fixing the violation and I brought it up again. This same board member stated he only goes by once a week to check on violations. I told him 10 days had passed and he stated that he would leave the violation on my account. I have never been fined or not fixed any violation. Is this legal? or am I being singled out? I contacted the main office about this and asked to speak to a supervisor, no answer and left a callback number and message, but no response. What are my options? Thanks

– Luis

Answer:

Hi Luis,

Kindly exhaust all forms of communication with the HOA board and management company such as text, email, mail, and call. It is also wise to bring up the issue at the next board meeting or head to their office in person. Moreover, there may be other members of the board whom you can contact. Otherwise, you may avail of third-party dispute resolution measures. The governing documents might outline what dispute resolution methods are available. Apart from this, you may also remove the problem board member(s) according to the procedure outlined in the governing documents. For further guidance, kindly consult a lawyer.
