California HOA Does Not Run Properly

Question:

We have a detailed 40-page CC&Rs for 12 homes mostly built in 2000. There are easements, elected members, biannual meetings, the whole nine yards. But, the homeowners mostly refuse to follow HOA rules, have no minutes, take action without authorization, and conduct meetings by ambush (2-day prior notice). How do I protect myself and other dissident homeowners along with getting in fully compliance with California law? My phone is 949-510-1100.

Make sure to check your governing documents for the full requirements of your community. You will generally need to elect board members who can enforce the rules, collect dues, and run the community properly. You should also make sure to hire an attorney to help you get compliant. The Office of the Attorney General of California also recommends contacting a private attorney for issues concerning the Davis-Stirling Common Interest Development Act, the HOA’s rules, or poor management of the association’s assets.
